Australian subcontractor reviewing construction contract clauses

Why Choose CCC

Three choices when a construction contract starts going wrong. Here's what each one actually costs you.

The real cost of getting it wrong

Most subcontractors know the contract is important. The question is whether the cost of addressing it properly is less than the cost of not addressing it. The answer is almost always yes.

Doing nothing

A time-bar clause can extinguish a legitimate claim worth $84k (or $840k) with no recovery path. One missed notice window. One missed date. The contract works exactly as written.

With CCC

A Rights and Obligations Review maps every date and notice obligation before work starts. A Notice and Template Pack means the notices are ready when you need them. The entitlement stays alive.

A $1,700 to $2,000/day consultant

A day-rate engagement is genuinely unaffordable for most subcontractors. At $1,700 a day, a two-day contract review costs more than the job's monthly margin. So it doesn't get reviewed. And the risk sits there.

With CCC

CCC structures its work as a fixed engagement or retainer, not a day rate. The same commercial expertise is applied to the same risk, at a price point designed for the $1M to $10M band.

Aconex or document management tools

Document management tools are excellent version-controlled repositories. They track correspondence, manage drawings, and keep a record. They do not read your contract, do not tell you what it means, and were not built for a subcontractor who needs to know what their notice obligations are today.

With CCC

CCC is not a software tool. It is a senior commercial operator who reads your contract, identifies your exposure, and tells you what to do about it. The deliverable is commercial advice, not a document store.

Option 1: Do nothing

This is the most common choice, and often the most expensive one.

Commercial construction contracts are written to transfer risk. Uncapped indemnities, aggressive liquidated damages clauses, tight notice windows for extensions of time. These provisions are standard and they are enforceable.

Miss an EOT notice window and the entitlement is gone. Accept a personal guarantee clause without realising it and the liability follows you beyond the business. One provision, misunderstood or unactioned, can turn a profitable project into a loss.

The cost of one missed entitlement typically outweighs a year of CCC.

Option 2: A day-rate consultant

Independent commercial consultants with the right experience charge $1,700–$2,000 per day. That rate is fair for what they know. It's simply not workable for most $1M–$10M subcontractors as an ongoing support structure.

It also means the support is reactive. You call when a crisis is already developing. The best commercial protection is upstream: reading the contract before you sign, setting up your notices before the project starts, catching emerging risk at the weekly delivery meeting rather than after it's crystallised.

CCC brings the same level of expertise at an accessible retainer structure, available before the crisis, not just during it.

Option 3: Document and project tools

Construction project management tools are built to organise documents and track progress. They do that well.

They don't read your contract. They don't tell you which clauses create risk, which notice windows are active, or whether your variation claim will survive a challenge. Filing a delay notice through a document portal doesn't make the notice valid. Validity comes from citing the right clause in the right form within the right timeframe.

CCC is not a software platform. It's a senior commercial operator who knows your contract.

What CCC actually gives you

The commercial protection of an experienced in-house commercial manager, available when you need it, without $250,000 in annual headcount.

We've worked across tier-one PPP and major infrastructure programs, administered contracts on billion-dollar programs, and we understand how the commercial side of construction actually works from the inside. That experience is what you're accessing.

The expertise behind the service

Ten-plus years administering contracts across billion-dollar programs. The same commercial rigour applied to a $2M subcontract that was applied on major national infrastructure.
